Terms of Service
These Terms of Service govern your use of ToneMuse (tonemuse.app). Please read them carefully before using the service.
1. Acceptance of Terms
By accessing or using ToneMuse (tonemuse.app), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.
2. Description of Service
ToneMuse provides gear-matched guitar, bass, and pedal tone settings, tone research, and community tone content. We may modify, suspend, or discontinue any part of the service at any time.
3. Accounts
You must sign in with Google to use ToneMuse. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.
4. Subscriptions and Payments
Paid plans (Beginner and Expert) are billed in advance on a monthly or annual basis, processed securely by our payment processor, Dodo Payments. All prices are listed on our Pricing page and may change; we will notify you before any price change takes effect. By subscribing, you authorize us to charge your payment method for the subscription period.
5. No Refunds
All payments for ToneMuse subscriptions are final and non-refundable. We do not offer refunds, prorated credits, or reimbursements for unused portions of a subscription period, for any reason, including non-use, dissatisfaction, or early cancellation. You may cancel your subscription at any time, but cancellation takes effect at the end of your current billing period and you will not receive a refund for the remainder of that period. Exceptions are made only where required by applicable law.
6. Cancellation
You can cancel your subscription at any time from your account settings. Your paid features remain available until the end of the current billing period, after which your account reverts to the free plan.
7. User Content
You retain ownership of content you submit to ToneMuse, including feature requests, feedback, and community tone contributions. By submitting content, you grant us a non-exclusive, royalty-free license to host, display, and use it to operate and improve the service.
8. Acceptable Use
You agree not to misuse the service, including attempting to access it without authorization, interfering with its operation, scraping community content, reselling the service, or using it for any unlawful purpose.
9. Intellectual Property
ToneMuse's name, branding, code, and original content are owned by ToneMuse, LLC and protected by intellectual property laws. The gear names, artist names, and song titles referenced in community tones belong to their respective owners and are used for informational purposes only.
10. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the service will be uninterrupted, error-free, or that tone settings will produce specific results on any particular equipment.
11. Limitation of Liability
To the maximum extent permitted by law, ToneMuse, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of your use of the service, even if advised of the possibility of such damages. Our total liability shall not exceed the amounts you paid to us in the twelve (12) months preceding the claim.
12. Termination
We may suspend or terminate your access to ToneMuse if you violate these Terms or misuse the service. You may stop using the service and delete your account at any time. Sections that by their nature should survive termination (including No Refunds, Disclaimer of Warranties, Limitation of Liability, and Governing Law) will continue to apply.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced on tonemuse.app or by email. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the applicable state or federal courts.
